Last December, fans around the world were devastated to learn of the abrupt passing of Stephen “tWitch” Boss, the charismatic DJ and dancer who rose to fame on “So You Think You Can Dance,” and the Ellen Degeneres Show. “tWitch” was not only a well-loved entertainer, but also a father of three and the spouse of Allison Holker Boss.
After his passing, Allison Boss discovered that not only did tWitch not have a will or trust to direct the disposition of his properties, but many of his assets were titled in his name alone, a manner of holding title that makes it more difficult for a surviving spouse to inherit the other spouse’s assets.
Luckily, there is a legal process that will allow a surviving spouse to obtain title to assets that would otherwise be considered community property, but for a lack of title as such, without the requirement of a full probate proceeding. The avoidance of probate is a primary objective of most estate planning and administration clients and attorneys, due to the time, cost and burden involved in the probate process.
Ms. Boss, through her attorneys, quickly filed a Spousal Property Petition pursuant to Cal. Probate Code section 13500, wherein she claimed title to tWitch’s assets and was able to obtain a Court order declaring her the rightful owner.
